What is DOLE Rule 1020?

DOLE Rule 1020 is the regulation on DOLE registration indicated in the Occupational Safety and Health (OSH) Standards that requires you, as an employer, to register your business or establishment with the Regional Labor Office. 

The OSH Standards are rules issued by DOLE, by virtue of R.A. 11058, which mandate the adoption and use of appropriate practices, means, methods, operations, or processes, and working conditions reasonably necessary to ensure safe and healthful employment.

R.A. 11058, also known as “An Act Strengthening Compliance with Occupational Safety and Health Standards and Providing Penalties for Violations Thereof,” strengthens compliance with occupational safety and health standards, thus imposing penalties for violations. These standards include new training requirements, on-site clinic facilities, audits, and tracking of compliance. Under the law, you, as an employer, must also inform your workers about workplace hazards, give them the right to refuse unsafe work, and provide safe facilities, and personal protective equipment, among others.

Who Requires DOLE Rule 1020 Registration?

As an employer and business establishment owner, you are required to register your business with the Regional Labor Office or an authorized representative with jurisdiction. This registration ensures that your business is included in the databank of all covered establishments, as stipulated under DOLE Rule 1021. 

Regardless of your establishment’s size or economic activity, whether medium or large-scale, each single location is considered one registrable unit (DOLE Rule 1022). You must complete the registration within thirty (30) days before starting operations (DOLE Rule 1023).

According to Section 29 (Prohibited Acts and Corresponding Penalties) of the Implementing Rules and Regulations (IRR) of R.A. 11058, any willful failure or refusal on your part to register your establishment as required by the law will result in an administrative fine of PHP 20,000.

DOLE Rule 1020 Registration Requirements

Unlike other business registration processes, the DOLE Rule 1020 registration has very minimal documentary requirements. You’ll typically need to submit the following:

DOLE Registration of Establishment Form (DOLE Rule 1020)

This form, which you can download from the DOLE official website, is used by the Regional Labor Office to register your business establishment under its jurisdiction.

You must provide a copy of your business registration document, i.e., Mayor’s Permit, SEC Certificate of Incorporation, or DTI Certificate of Business Name Registration, whichever is applicable.

You also need to provide your business establishment’s details, such as the name of the company, office type (i.e., either parent or branch), complete address, number of male and female employees, nature of business, and contact information. Make sure to have these ready for filling out the registration form.  

How to Register with DOLE Under Rule 1020

The DOLE Rule 1020 registration of employers and business establishments is processed with the DOLE Regional Office onsite or through its official website (e.g., DOLE-NCR e-FIling Service (Client Portal) for NCR), if available.  

1. Prepare the DOLE Rule 1020 Registration Form. 

Start by downloading and filling out the DOLE Rule 1020 Registration Form. Take note that the form requires your wet signature as the employer or business owner. Once finalized, scan it together with the business registration certificate. Upon scanning, ensure that all files are in portrait orientation, details clear and readable (e.g., at least 100 x 100 dpi), and pages (for multi-page documents) are in proper order.

2. Accomplish the Online Registration Form and Upload the Documents.

After preparing all the documents, visit the DOLE Regional Office Client Portal (for NCR) and click Services. Under Permit and Registration (Services), select Establishment Registration Under Rule 1020, fill out the online form, and upload the supporting documents. 

3. Wait for the DOLE Approval of Registration. 

Normally, it takes one (1) to two (2) days for the DOLE to review and approve the application. You may check the status on the same portal via the Track My Application feature by simply typing the transaction number. Once approved, print the confirmation page. 

4. Receive the DOLE Certificate of Registration.

With a copy of the confirmation page, proceed to the DOLE-NCR Regional Office at DOLE-NCR Building 967, Maligaya, Malate, Manila (for NCR) to claim the DOLE Certificate of Registration.

The DOLE registration of business establishments under Rule 1020 is valid for a lifetime unless there is a change in the registration details (i.e., name, address, and ownership) or a need to reopen the establishment after its previous closure.
